To the Honor? Body composeing the Dawes Commision
We EH Sooter EP Sooter and GB Sooter
respectfully Submit for your consideration our
application for citizenship in the Cherokee Nation-we
claim a right to citizenship because we are
descendants of Jeraniah Fly who according to our information
and belief was of cherokee Blook. our mother Martha
Sooter whose maiden name was Marth a Fly. she
was a dughter of Jeramiah Fly we have and affidavit
of Ex cheif John Ross also an affidavit fo
Prisey Capps of Going Snake District I.T. Stating
that our Mothers Father was of Cherokee Blood and
they say in their affidavits that they were aquainted
with our Grand Father Jeramiah Flys family and
know our Mother married Edward Sooter and was
aquainted with our Father and his family
We Submit for your consideration the affidavits
of John Ross and Prisey Capps-our Grand Father and
parents came west about the time the cherokee came
west-and our Grand Father and our Parents settled
in Southwest Missouri-the above is true and
correct according to information and knowledge-
our Grand Father and our Parents lived in Tennessee
before they moved west."

for citizenship in the Cherokee Nation
Your respondent, S.H. Mayes, Principal Chief of the cherokee Nation, comes now
and demurs the said application, and for the grounds thereof says:
1st. That this Commision has not jurisdiction over the parties or subject matter
of this controversary, and no legal right, therefore, to hear and determine the
same.
2nd. That the application does not state facts sufficient, if true, to show that
the applicant ______entitled to citizenship.
Respondent no waiving his aforesaid demurrer, but insisting upon the same for
answer to said applicaiton, says that Jeremiah Fly whom the petitioners derive
their right to citizenship in the Cherokee Nation, is not now, and has not been
a citizen of the Cherokee Nation since the removal of said Nation, west to the
Indian Territory as at present located and defined: that their names do not appear
on any of the authenticated rolls of said Nation: that neither they nor any of
their ancestors now reside, or ever have resided in the Cherokee Nation and Indian
Territory as citizens thereof.
Having fully answered, your respondent asks to be hence dismissed.
