2 CONT      As attorney for Dr. Nelson I felt that I should write to you as to t
2 CONC he purpose of the petition.  Dr. Nelson was appointed guardian of the p
2 CONC erson and property of these children by the Probate Court of douglas, K
2 CONC ansas on the 29th day of December, 1960.  Needless to say, since both t
2 CONC he children and Dr. Nelson reside in South Bend, Indiana, from the stan
2 CONC dpoint of distance, this is a very inconvenient arrangement.  There is a
2 CONC lso the question of the jurisdiction of the Kansas court since all of t
2 CONC heparties permanently reside outside of that state.

2 CONT     Actually the Kansas Guardianship should be transferred to Indiana; b
2 CONC ut the law makes no provision for such transfer.  Accordingly steps hav
2 CONC e been undertaken to close the Kansas Guardianship and to re-open it he
2 CONC re in South Bend.  There will be no change in anything excepting thep l
2 CONC ace where the Guardianship has its legal situs.

3 CONT Mr. Russell died April 12, 1993 following a lengthy illness.
3 CONT He was born May 3, 1923 in Gavette, Arkansas.  He married Phylliws, Oct
3 CONC ober 5, 1968 in King city (Ca.)
3 CONT Russell was a World War II veteran of the Army/Air Force, and a member o
3 CONC f the Disabled American Veterans.  He retired in 1985 from the State of C
3 CONC alifornia, where he was an employment officer for 25 years.
3 CONT Russell loved to fish, with stream fishing his favorite, and he loved t
3 CONC he outdoors, rock hunting, exploring old ghost towns and getting lost i
3 CONC n the search or the return of such escapades.
3 CONT In his earlier life he farmed and graduated to an accomplished gardner w
3 CONC here he was known for his fine fresh vegetables.
3 CONT His is survived by his wife, Phyllis, Alturas: daughters Terry Russell, C
3 CONC hico; Cally Dobeck, Belgrade, Montana; sons, Richard, Fayetteville, Ark
3 CONC . Roger, Napa, and Andrew Russell, Las Vetgas; stepchildren, Richard Cl

2 CONT      Eleanor's condition is about the same.  She seems to be quiet duri
2 CONC ng the day, but most every night she has violent reactions that are una
2 CONC ffected by sedatives.  All of the doctors agree that she must have trea
2 CONC tment.
2 CONT      I am doing everything in my power to get her treatment as soon as e
2 CONC arthly possible.  She will be removed to a state hospital within a few d
2 CONC ays as soon as the legal part is taken care of.  I spoke with the Distr
2 CONC ict Attorney this a.m. and he said it will be taken care of monday.
2 CONT      She is being taken care of very well and she is under observation i
2 CONC n a good hospital.
2 CONT      The doctor says he is sure that the beginning was several years ag
2 CONC o, that usually these things start and keep growing until some pressure m
2 CONC akes the final break.  He says that she has three different symptons th
2 CONC at indicate this.  After shock treatment is applied they are able to ge
2 CONC t at the origin and start correction from there.
2 CONT      I am so very, very soory for her now.  But, I am praying that reco
2 CONC very will leave her without this complex mental pattern that has preyed o
2 CONC n her for so long.
2 CONT       I think of only one way that you could help at this time.  If you c
2 CONC ould write a letter for the doctors giving all the details of her child
2 CONC hood that you can remember I am sure that it will help.  One incident i
2 CONC n particular I think will be important.  she talks a lot about a fire a
2 CONC nd although I can't get mujch from what she says, I seem to remember th
2 CONC at her maother was killed by fire also that she became almost hysterica
2 CONC l when we had a small business destroyed by fire here in Brawley.
2 CONT      The children are with Maria the same woman we have had for three y
2 CONC ears.  Am fortunate that she is excellent.
2 CONT      The children had a very big christmas.  Thank you for the gifts an
2 CONC d Relay my thanks to the others who sent.  I have been so upset and wit
2 CONC h so many things to be done I find my work piling up more every day.  W

2 CONC auben.  From there they went to Ft. Scott and were united in marriage a
2 CONC t the Court House, the Judge administering the legal ceremony.
2 CONT    This worthy young couple require no indroduction to local citizens, b
2 CONC oth are well known and among our most popular young people.  The groom i
2 CONC s the son of Mr. & Mrs. Andrew Russell ("Andy" is otherwise known as s.
2 CONC ... the W.J. Burns of Northwest Arkansas, having apprehended more crook
2 CONC s and criminals than any other sheriff the county ever had.)  Everett w
2 CONC as one of Gravette's  volunteer army and served in the Radio staff of B
2 CONC attery "D" 142nd F.A. as Corporal, spending several months overseas.
2 CONT    The bride, daughter of Mrs. Frank Dyer of this city is a young lady o
2 CONC f merit and ability and enjoys the esteem and respect of our citizenshi
2 CONC p.  She was educated in Gravette High School and Springfield Business c
2 CONC ollege, and has been employed as stenographer most of the time since.

2 CONT    She was the wife of the late Everete Russell. She was born in Rogers a
2 CONC nd later moved to Gravette with her family.  She was married in 1919 an
2 CONC d moved to Home, Mo., and later moved to Bentonville in 1929 where she h
2 CONC ad lived since.  She was member of the First Baptist Church and the Ben
2 CONC tonville chapter of Eastern Star.
2 CONT   Survivors include:  Two sons, Leonard, Salinas, Calif.; and Robert, B
2 CONC entonville,; her mother, Mrs. Effie Simpson, Bentonville; two sisters, M

2 CONT John recalls hearing the stories of her parents leaving Benton in order t
2 CONC o find work, picking cotton.  That was before the birth of their first c
2 CONC hild.  Johnson's oldest brother was born in a church, just across from t
2 CONC he Drake field airport in Fayetteville.  They just didn't quite make it t
2 CONC o Benton Co. before mama had her first baby, they were headed here.
2 CONT Later, the couple made it to farm land near Gravetts.  They established G
2 CONC eorgia Flats.
2 CONT In addition to farming, Russell served as a Benton County deputy prior t
2 CONC o being elected to the Sheriff's seat.  After the win, the family, then
2 CONC , moved to the downstairs portion of the jail while the prisoners were h
2 CONC eld upstairs.  Although, Johnson doesn't remember her axact age at that t
2 CONC ime, she believes she was already a teenager.
2 CONT She recalls that her father had one deputy.  During her father's tenure
2 CONC , her mother cooked three meals a day for the prisoners, which could am
2 CONC ount to 36 people, in addition to the large family.
2 CONT We cooked a lot of meals for the prisoners, she said.  we got 25 cents a m
2 CONC eal.  It was paid by the county.
2 CONT A couple of the prisoners stand out in her memory.  She tells about one p
2 CONC risoner who was locked up for murder.  "He hunted pearls and sold them.  I t
2 CONC hink this took place near War Eagle.  These two men ordered him around, t
2 CONC hen they robbed him and they took most of his pearls out of his pouch, h
2 CONC e killed one of them for it."
2 CONT It was beautiful, in later years she had the pearl mounted and gave it t
2 CONC o her daughter.
2 CONT The other prisoner was a school teacher "who went off his rocker, and b
2 CONC egan to baptize children, I don't remember his exact charges".

2 CONT Growing up with six brothers and six sisters.  That was during a time w
2 CONC hen there was no such thing as a telephone, electricity, indoor plumbin
2 CONC g or television.  Children didn't have much time to play. Chores and sc
2 CONC hooling took up most of the time during the day for younsters.  The chi
2 CONC ldren used to pick strawberries for a penny a quart.

2 CONT Bath water was always heating in the reservoir on her maother's Majesti
2 CONC c cook stove.  During the summer, baths were taken in a metal watering t
2 CONC rough tub which occupied an honored position on the back porch.  you ha
2 CONC d to wait until dark so no one would see you, or you had to take it in t
2 CONC he kitchen.  A black, cast-iron post also sat our in the yard.  A fire w
2 CONC as routinely lit under it in order to get the laundry clean.  Then, pie
2 CONC ces of clothing were hung dry on thenearby clothline.  There was plenty o
2 CONC f laundry and cooking with such a large family.
2 CONT In the fall, my dad would buy 100 pounds of sugar and in the spring, he w
2 CONC ould buy another 100 pounds.  It cost $5.00 for 100 pounds.  We always g
2 CONC rew our own food and we used the sugar for canning and baking.

2 CONT      The funeral service for Andrew J. Russell, 78 years old, who died a
2 CONC t his home near Gravette monday after a long illness, was held wednesda
2 CONC y morning at the Babtist Church by the Pastor, Rev. John V. Stephen, as
2 CONC sisted by Rev. ARthur Hart of Mason Valley.  Burial was in the Gravette C
2 CONC emetary with six grandsons acting as pallbearers.

3 CONC orn Dec. 1, 1904, in Gravette, the daughter of Andrew Jackson and Peggy R

3 CONT    Mrs. McCurdy was a graduate of the University of Arkansas where she r
3 CONC eceived her Master of Arts degree in 1967.  A teacher at Droke school, s
3 CONC he later was principal at Lowell Elementary and retired as principal fr
3 CONC om Rogers Ewstside Elementary School.  She was elected to the Rogers Sc
3 CONC hool hall of fame in 1996.  As a teenager she was elected Apple Blossom Q
3 CONC ueen of Benton County.
3 CONT   Survivors include two sons, Andy McCurdy and Bill McCurdy, both of Ro
3 CONC gers; one daughter, Liz Means of Springdale; three sisters, Beulah Gill
3 CONC man of Carthage, Mo, Stella Botts and Bessie Borwn, both of Kansas City
3 CONC , Mo.  six grandchildren and two great-grandchildren.
3 CONT   Private graveside services were held August 14 at Rogers Cemetery wit
3 CONC h Rev. Jack Garner officiating.  Arrangements were under the direction o
3 CONC f Callison-Lough.
3 CONT   Memorials may be made to the Beaver Lake Literacy Council.

3 CONC niversity of Arkansas.

3 CONC ov. 26, 1935.  He died in December 1981.

2 CONT My great-great grandmother was Eliza Jane Kirk, born in TN in 1826 or 2

2 CONT Her father was John Kirk.

2 CONT Now there were 2 John Kirks in the area at the time and we always thoug
2 CONC ht we
2 CONT knew which one Eliza belonged to, but we uncovered some info in a Hartl
2 CONC ey
2 CONT family will (we thought her mother was Mary (Polly) Hartley) that lists
2 CONC
2 CONT "most" of the children and Eliza is not on the list. In fact, we find n
2 CONC o
2 CONT mention of Eliza until she gets married in 1847.

2 CONT Now, one of the folks I was going to connect you up with KNOWS which Jo

2 CONT Kirk she belongs to (John W. Kirk) and it is this line of Kirks that wa

2 CONT involved in the Kirk Family Massacre in 1788, just south of what is
2 CONT currently Maryville, Blount County, TN. (Her husband is descended from
2 CONT Joseph Kirk, son of John, Sr., in the massacre story below.) I was just
2 CONC
2 CONT there last week and saw the site.
2 CONT
2 CONT If you don't know about the massacre, there are several write ups about i
2 CONC t
2 CONT and it goes like this:
2 CONT
2 CONT It's 1788. John Kirk, Sr., and his son John, Jr. (about 18), and a youn
2 CONC ger
2 CONT son Joseph, had gone to the mill. Some Cherokees appeared at the home a
2 CONC nd
2 CONT killed the wife and 5 or 6 kids. One daughter was still barely alive wh
2 CONC en
2 CONT the men returned and identified the Indians (the family had often fed t
2 CONC hem
2 CONT and they had been friendly in the past, evidently). Then the girl died.
2 CONC
2 CONT
2 CONT John, Jr. went out for revenge with some other men, including John Sevi
2 CONC er.
2 CONT The found the Indians in question (and probably some not involved). I'd h
2 CONC ave
2 CONT to look to get it all correct, but John Sevier left the men and went of
2 CONC f
2 CONT somewhere, knowing the state of mind they were in and aware of what wou
2 CONC ld
2 CONT likely happen. The Indians showed the white flag, the men crossed the r
2 CONC iver.
2 CONT The Indians, several old and famous chiefs among them, were in a hut. A
2 CONC fter
2 CONT Sevier left, someone gave John, Jr.(or he picked up) a hatchet and told h
2 CONC im
2 CONT to go get his revenge. He went in the hut and killed 6-7 Indians.
2 CONT
2 CONT A hue and cry went up (on both sides) and John Sevier ended up getting a l
2 CONC ot
2 CONT of the blame. Sometime after this, John, Jr., wrote a letter to one of t
2 CONC he
2 CONT Indians that is supposed to have been published in the GA Gazette. It i
2 CONC s
2 CONT that letter I am looking for. We have a transcription, but want to see t
2 CONC he
2 CONT original newspaper. In the letter, John, Jr., accepts responsibility fo
2 CONC r his
2 CONT actions to spare John Sevier.
2 CONT
2 CONT The 2 letters I copied from the Gazette are about the massacre--one lis
2 CONC ts
2 CONT the killed and wounded (altho' I think this is a separate fight after t
2 CONC he
2 CONT original massacre) and one condemns the men who retaliated following th

2 CONT original Kirk massacre (altho' does not name names).

2 CONT All this happened when Sevier was trying to get the State of Franklin
2 CONT organized and boundaries were changing. The Cherokees were signing trea
2 CONC ties
2 CONT with NC, the US, and Franklin. The Kirks thought they were in NC, but w

2 CONT actually settled on Indian land.

2 CONC 840 Arkansas census records.  I know he was there because his sons JOHY
2 CONC N L and WILLIAM were born in Arkansas.  John was born about 1833.  A I h
2 CONC ave a story written by Gayle Adell Russell (daughter of Samuel Nicholas
2 CONC , Son of John L Russell 1833, son of Samuel Russell 1811-1812.  I also h

2 CONT A.J.'s grandfather was Samuel Russell, of Rhea Co. Tenn.  He wasin the w

3 CONC ckers followed him and killed him.  they then came bac to the house, an
3 CONC d Martha Ann's sister asked them if they killed her Daddy.  they said "
3 CONC No, he got away".  The family kept the suspenders that he was wearing t
3 CONC hat day, with a big hole in them, where the shot went through them.
3 CONT      The bushwackers then got a shoval of fire, to set fie to the house
3 CONC .  Martha ann threw water on the coals of fire which make the steam go i
3 CONC nto their faces.  They were so angry that they threatened to kill Marth
3 CONC a Ann.  She said "just go ahead, if you are that big a coward".  They b
3 CONC urned the house and everything they had, then took the team-that was al
3 CONC l they had in the world.
3 CONT       Aunt Fronie Callis made the coffin (casket) to bury him in, (Elij
3 CONC ah Russell).  It was made from rought oak boards.
3 CONT      They put thye coffin on a two wheeled cart.  They had nothing with w
3 CONC hich to pull the cart but got an ox from a neighbor and pulled it to th
3 CONC e Gambel Cemetery where they buried him.  Women had to do all of this a
3 CONC s the men were away fighting.
3 CONT      This is a little example of how the North did the South.  No wonde
3 CONC r the South hated them for so long.

3 CONC ried to Berry Sooter and then to Wyatt Coffelt who preceded her in deat
3 CONC h.  The old lady was laid to rest in Coffelt cemetery southwest of Cent

3 CONC e was again married to Berry Sooter and a thrid time married Wyatt Coff
3 CONC elt, both of whom preceded her in death.  Grandmother was the mother of s
3 CONC ix children, Mrs. R. Gaylean, Mrs. E.H. Setser, who survive her, Mrs. J
3 CONC .H. Fair, who died in 1899, G.W. Rusell in 1887, on the fortieth annive

3 CONC t remarkable lives I have ever known, her earthly treasures were her re
3 CONC latives and her friends, of which she possessed many.  She lived in mem

3 CONC h 1849.  Was converted at a quarterly meeting at Center Point, this cou
3 CONC nty, April 7th, 1867 and joined the M.E. Church, South and lived a cons
3 CONC istent Christian until Jumne 25th, 1899 when she fell asleep in Jesus.  S
3 CONC he was married by Rev. Wyatt Coffelt to J. A. Fair, Marth 14th, 1869.  W
3 CONC as the mother of nine sons and three daughters of whom eight sons and o
3 CONC ne daughter survive to mourn with their father the irreparable loss.  H
3 CONC er sufferings were intense but she "endeured as seeing Him who is invis
3 CONC ible."  Her husband often wondered at the patience with which her affli
3 CONC ctions were borne.  The funeral services were conducted by Rev. H.D. Hu
3 CONC tchinson, a former pastor.  She was ever ready to visit the sick.  Her n
3 CONC eighbors loved her.  She was a kind, loving mother as her children can t
3 CONC estify.  To her husband she was a help mate, a companion dear, who for m
3 CONC ore than thirty years trod "the rough paths of the world by his side, t
3 CONC o his pleasures adding joy, subtracting dsorrow from his cares, mulitpl
3 CONC ying the hopes of coming years, dispelling the gathering cloud."  Farew
